The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. - Dispute Resolution and Binding Arbitration.

ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS OR SERVICES THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.

The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the Agreement is void, voidable or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.
If you prevail on any claim that affords the prevailing party attorneys’ fees, the arbitrator may award reasonable fees to you under the standards for fee shifting provided by law.
- You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR GIFTBOMB WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.
If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced.
- Assignment. You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this 13 is null and void. No assignment or delegation relieves you of any of your obligations under these Terms. We may assign these Terms and all of our rights and obligations under it to a third party in our sole business discretion.
- No Waivers. The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Giftbomb.
- No Third-Party Beneficiaries. These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
- Notices.
- To You. We may provide any notice to you under these Terms by: (i) sending a message to the email address you provide or (ii) by posting to the Website. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
- To Us. Any notice to us permitted or required by these Terms shall be deemed given on the date of personal delivery or five (5) days after deposit in the United States Mail, with first class postage fully prepaid, and a return-receipt requested. Personal delivery of a notice via a nationally-recognized courier will be valid upon delivery provided the courier obtains a signed receipt. Notice by email shall be valid provided the sender receives an acknowledgement of receipt by a return email from the same email account or by another means providing a written record of the acknowledgment.
- Severability. If any provision of these Terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
- Entire Agreement. Our confirmation of your order, these Terms, our Website Terms of Use, and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.

The Giftbomb mobile application enables users to send, receive, and manage electronic gift cards (the “Application”). The Application is owned and operated by Giftbomb, a Delaware corporation with its principal office in Minneapolis, Minnesota (“Giftbomb,” “we,” “our,”) and its licensors. The Application is provided subject to all terms and conditions of this Privacy Policy. When used in these Terms, “you,” “your,” and “user” refer to all persons using the Application for any purpose.
BY USING THE APPLICATION, YOU AGREE TO THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, YOU MAY NOT USE THE APPLICATION. GIFTBOMB HAS THE RIGHT TO REVISE THIS POLICY AT ANY TIME. Scope of this Policy
This Policy applies only to information collected through this Application. It does not apply to third-party websites or third-party mobile apps. It also does not apply to information collected through other channels, such as over the phone or in person.
Information We Collect
We collect the information you manually provide to us, using your keyboard or touchpad. For example, all users must provide the following information to establish and maintain a user account: mobile phone number, country of residence, first and last names, gender, date of birth, and email address. With your opt-in consent, Giftbomb may also access and use information stored on your mobile device and accessible through the device’s file or operating system, such as photographs, audio files, and personal contact and address book information (“Stored Information”).
With your opt-in consent, Giftbomb may also collect real-time information concerning your location using the GPS functionality offered by your mobile device (“Location Information”).
Giftbomb may also collect information regarding your use of the Application using mobile device identifiers, IP addresses, browser and operating system identifiers, and software tracking tools and files, such as cookies and web beacons (“Usage Information”). Usage Information is not, in and of itself, personally identifiable, but we may combine it with other information in an attempt to identify you or we may combine it with information that does identify you.
Use of Mobile Phone Number
We may use your mobile phone number to communicate with you and your gift recipients concerning all aspects of the Application. You may opt out of receiving electronic messages from Giftbomb at any time by texting STOP in response to a message received from the Application. Pursuant to the separate Terms of Use, we will continue using your mobile phone number for as long as you remain a registered user of the Application, or until you expressly revoke the consent to use your mobile number.
If you revoke your consent for the use of your mobile number, you will not be eligible to use the Application and your account will be suspended or terminated without further notice.
Third-Party Information Collection
When you use the Application or its content, certain third parties may use automatic information collection technologies to collect information about you or your device.
For example, we use Google Analytics, a web analytics tool that helps us understand how visitors engage with our Sites. Other third parties may collect information about you or your device for the purpose of tracking your online behaviors across non affiliated websites and applications and delivering targeted advertisements to you.
You have choices about the collection of information by third parties on the Application. For example, if you don’t want information about your visit to this Site sent to Google Analytics, you may download an Opt-out Browser Add-on. Please note that the Add-on does not prevent information from being sent to Giftbomb.
In addition, if you would like to opt out of having participating entities collect your behavior for advertising purposes when you are using the Application, download and use the Digital Advertising Alliance’s “App Choices” app. It may be that some of the third parties that collect interest-based information on this Application do not participate in the Mobile App Opt Out, in which case the best way to avoid third-party tracking of your behaviors is to contact the responsible provider directly. Please note that the Mobile App Opt Out is device specific. If you wish to opt-out from having interest-based information collected by participating entities across all devices, you need take the steps outlined above from each device.
Use of Your Information
We use the information collected through this Application for the following purposes:

If you have questions about how a particular merchant may be using your Personal Information, you should contact the merchant.

From time to time, we may share your information with selected third parties (other than our Third-Party Service Providers or merchant clients) for joint or their own marketing purposes. Before doing so, however, we may offer you the opportunity to “opt out” or “opt in,” as required by applicable law.
